Notification on behalf of the Copyright Owner must include:

1. Identification of the copyrighted work claimed to have been infringed and the manner of use which is claimed to constitute an infringement.
2. Identification of the owner of the copyrighted work.k.
3. A signature of the Copyright Owner or a person authorized to act on their behalf (electronic or physical signature, in permanent ink).
4. Information sufficient to permit Rockstar to locate the copyrighted work at issue. Sufficient information includes where the work is located on the Rockstar site, the name or number of the file where the work is located, and any indexing information that might be associated with the work (e.g. author, title, page, date, etc.).
5. A statement that the Copyright Owner has a good faith belief that the use of the material in the manner complained of is not authorized by the Copyright Owner, its agent, or the law. Along with a statement under penalty of perjury that the information in the notification is accurate.
6. Information sufficient to permit Rockstar to contact the person submitting the complaint on behalf of the Copyright Owner (including, name, address, phone number, email address).

Upon receipt of a properly submitted written notification, Rockstar will:

1. Attempt to locate the information as identified.
2. Remove, or disable access to, the material.
3. Forward a written notification that a complaint has been received from the Copyright Owner and that the information complained of was removed from the system.

The Rockstar site user may, at its election, provide a counter-notification to Rockstar within twenty-one (21) days of receipt of the Notification. The counter-notification must include:

1. An identification of the material that was removed (or to which access has been disabled).
2. A signed statement under penalty of perjury that the customer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
3. The name, address, and telephone number of the customer along with a statement that the customer consents to the jurisdiction of the U.S. Federal District Court for the judicial district in which the address is located. Alternatively, where the customer is located outside the United States, a statement that the customer will consent to jurisdiction in any judicial district where Rockstar is found and that the person who provided the counter-notification (or an agent of that person) will accept service of process for any judicial proceeding relating to any continued use of the material.

Upon receipt of the counter-notification containing the information outlined above, Rockstar will:

1. Promptly provide the Copyright Owner (or agent) with a copy of the counter-notification.
2. Inform the Copyright Owner (or agent) that it will replace the removed material (or cease disabling access) within fourteen (14) days.
3. Replace the removed material (or cease disabling access) within twenty-one (21) days following receipt of the counter-notification provided that Rockstar does not receive notice from the Copyright Owner that an action has been filed seeking a court order restraining the Customer’s use of the information.

You agree that you will not falsify, delete or alter author attributions, legal or other proper or proprietary notices, designations or labels of any material that is uploaded.

You agree that you will not defame, abuse, harass or otherwise violate the legal rights of others and that you will not publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene or indecent material or information.

You agree that you will not violate any applicable laws or regulations.

This site may contain links to other sites operated by third parties. Rockstar has no control over the content or accuracy of information provided on other websites. Further, Rockstar has no control over the Privacy Policy of those websites.  Third parties may also create hyperlinks from their web sites to Rockstar. This agreement is governed by the laws of the State of California, United States of America, without regard to its conflicts of law principles.  In the event of a dispute between you and Rockstar arising out of, or relating to, your use of this site, you agree that the sole jurisdiction and venue for any such litigation shall be an appropriate federal or state court located in Los Angeles County, California.

“ROCKSTAR 2011 CONSUMER” PROMOTION

TERMS AND CONDITIONS

1.    Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2.    Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3.    To be eligible to enter, individuals must purchase any 500mL Rockstar Original, 500mL Rockstar Guava Punched, 500mL Rockstar Cola , 500ml Rockstar Recovery, 355mL Rockstar Perfectberry or 4 x 500mL Rockstar Original Multipack from any participating Caltex store nationally between 9.00am AEST on 20/07/11 and 11:59pm AEST on19/09/11 (‘Promotional Period’).

4.    To enter, individuals must then send an SMS to 1998 8777 containing the last four (4) digits of their product barcode, full name, email address and postcode (in that order, with a space between each word of piece of information), so that it is received by 11.59pm AEST on 19/09/11. Each entrant will be notified instantly by return SMS whether or not they are an instant prize winner. Premium SMS cost is 55c. Entrants must have premium service access. SMS helpline: 1800 855 702. SMS entries via the Internet are ineligible. Entries are deemed to be received at the time of receipt into the promotion database and NOT at the time of transmission by the entrant.

5.    All valid entries received, regardless of whether or not from an instant prize winner, will automatically be placed into the relevant Minor Draw and Major Prize Draw.

6.    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7.    Incomplete or indecipherable entries will be deemed invalid.

8.    Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; (c) unrecognised barcode numbers will be deemed invalid; and (d) a maximum of three (3) entries per person per day is permitted.

Entrants must retain their original Caltex purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.

9.    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

10.    Promotion commences 9:00am AEST on 20/07/11. Entries close 11.59pm AEST on the dates specified in the table below. All draws will take place at 10.00am AEST at The Consortium Centre, 87 Egerton Street, Silverwater NSW 2128. Minor and Major Draw winners will be notified in writing within two (2) days of the draw. Minor and Major Draw winners will have their names published at www.rockstarenergy.com.au commencing on the dates featured in the table below. The names of any Minor or Major Draw winner/s from VIC/SA will be published in The Australian on the dates specified in the table below. 11.    The Promoter’s decision is final and no correspondence will be entered into.

12.    Instant win prizes include:

-    20 x Rockstar branded backpack valued at $70.00 each.
-    20 x Rockstar branded hat valued at $25.00 each.
-    45 x Rockstar branded motorcross jersey valued at $50.00 each.
-    15 x Rockstar branded motorcross velocity helmet valued at $400.00 each.

13.    The first five (5) valid entries drawn in each Minor Draw (20 winners in total) will each win a Rockstar Cooler and products pack. Each prize includes a Rockstar branded Cooler and one (1) x year supply of Rockstar Energy Drink. This equates to 31 cartons of 12 units from the Rockstar range. Prize pack valued at $1,750 each. Total Minor Prize Draw total is valued at $35,000.

14.    The winner of the Major Draw will win a trip for two (2) adults to Phillip Island, Victoria, to ride in a HRT Hot Lap valued at up to $8,500 depending on date and point of departure. Prize includes one (1) night twin share accommodation at the Silverwater Resort and breakfast for two. If the winner is not from Victoria, the prize also includes return economy airfares from the winner's nearest capital city and return airport transfers. If the winner is from Victoria then the prize does not include airfares or airport transfers and the airfare/transfer component of the prize is not redeemable for cash. Spending money, meals, insurance, taxes (excluding airline and airport taxes), transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by 14/12/11 and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or other peak periods.

15.    Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.

16.    The HRT Hot Lap prize (“the Activity”) and their companion acknowledge that the Activity is a dangerous activity that may result in injury or death, and participate at their own risk. The winner and their companion must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or their companion from participating in the Activity if, at any time, they reasonably believe that the winner or their companion poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.

17.    If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

18.    Total prize pool value is $53,650.

19.    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

20.    A draw for any unclaimed prizes may take place on 20/12/11 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified by SMS and phone within two (2) days of the draw. Winners of a prize valued at over $250.00 will have their names published at www.rockstarenergy.com.au on 29/12/11 and winners of a prize valued at over $250.00 from VIC/SA will be published in The Australian on 29/12/11.

21.    Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

22.    If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

23.    Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions or if the number of entries received is less than the number of prizes available, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool will be awarded in the corresponding minor draw. There will be a total of one hundred (100) instant win notifications for this promotion.

24.    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

25.    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, The Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the HRT Hot Lap is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize/participation in the HRT Hot Lap.

26.    As a condition of accepting the prize, the winner (and any companion) must sign any legal documentation as and in the form required by the Promoter/Prize Supplier/organisers in their absolute discretion, including but not limited to a legal release and indemnity form.  

27.    The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

7. Las personas ganadoras serán notificadas por teléfono y/o correo electrónico para recoger0 su premio.Se intentará contactar a los ganadores vía telefónica en al menos dos (2) ocasiones. Una vez notificadas, las personas ganadoras tendrán 48 horas para reclamar su premio. Una vez transcurrido dicho término sin que la persona ganadora reclame el premio se entenderá que renunció al mismo y éste le será adjudicado a un ganador alterno. En caso de que la persona ganadora sea un menor de edad, éste tendrá que reclamar su premio por conducto del padre o madre custodio o tutor legal acompañado por éste(a).
